The Madras High court on Friday refused to restrain the media from publishing oral observations made by the court against the Election Commission of India (ECI) for surge in Covid -19 cases.
The first bench of the Madras High court represented by Chief justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy refused to grant any relief despite the repeated requests by the Council of the ECI, Rakesh Dwivedi.
The Court had on April 26 during the hearing of a suomoto PIL initiated by the court made oral observations that ,” The ECI is the institution responsible for the situation prevalent today and that the ECI should be put up for murder charges”. The Senior council of the ECI pleaded before the court that this had caused grave prejudice to the commission.
Advocate Rakesh Dwvidi also presented before the court that police complaints were being filed against the commission. However the court refused to accept the contentions and the bench observed, “Courts are there and they can be approached if any frivolous complaints are given before the police.”
