A division bench of the Madras High Court refused to stall the AIADMK general council meeting slated for July 11th. Justices M. Duraisamy and Sundar Mohan of the Madras High Court made it clear on Monday that the order passed by them on June 23rd early morning at 4.40 am was only with respect to the meeting held on that day.
The court directed the advocate of M. Shanmugham, AIADMK state council member that they can approach the single bench of the court if necessary.
The bench also provided time till Thursday for senior counsel Vijay Narayanan representing Edappadi K. Palaniswami to file counter-affidavits to new applications. The counter appeal is to be filed to a series of three applications taken out by M. Shanmugham in his original side appeal pending before the Madras High Court.
One of the three applications was to stall the July 11th general council meeting of the party, the second was to stay the appointment of A. Tamilmagan Hussain as the presidium chairman of the party. The third was to punish the top leadership of the party for having allegedly defied the June 23rd order of the division bench.
Senior Council P.H. Aravind Pandian representing O. Panneerselvam informed the court that the appointment of Tamilmagan Hussain as presidium chairman amounted to contempt. The senior counsel also said that the announcement of the next general council meeting by the presidium chairman was in defiance of the court order.
Aravind Pandian contended that the division bench had on June 23rd made it clear that no decision should be taken on any issue but for the 23 draft resolutions approved by O. Panneerselvam.
The senior counsel representing the Paneerselvam faction said that the party leaders went ahead and appointed the presidium chairman whose name was proposed by Edappadi. K. Palaniswami.
The bench adjourned the hearing to Thursday as the Supreme Court was also slated to hear an appeal filed by the Edappadi K. Palaniswami faction against the division bench’s June 23 order.
